Brownfields Redevelopment Program
Site Eligibility Criteria
The determination as to whether a piece of real property is eligible for participation in the Brownfields Redevelopment Program must be made on a case-by-case basis. As every project presents a unique set of circumstances, the eligibility determination must be made following review of all pertinent facts and considering the totality of the circumstances.
Generally, property must be impacted by the presence or potential presence of a hazardous substance, pollutant, or contaminant, and must be located within the City of Houston or City of Houston's Extra Territorial Jurisdiction.
The following properties are prohibited from participating in the City of Houston’s Brownfields Redevelopment Program:
- Superfund sites;
- Resource Conservation and Recovery Act (RCRA) permitted or Interim-status facilities; and
- Properties involved in or targeted for any federal or state enforcement action.
