Incident at 7715 Harrisburg
April 24, 2006 -- A suspect
has been arrested and charged in the fatal shooting of one man
and wounding of two other persons at 7715 Harrisburg about 7:55
a.m. on Sunday (Apr. 23).
The suspect, identified as Esteban Garza (H/m,
DOB 9-2-55), has confessed to his role in the shooting and is
charged with murder and two counts of aggravated assault with
a deadly weapon in the 338th State District Court. He is accused
in the killing of Fernando A. Gutierrez, 43, of 7633 Glen Manor,
and wounding of Nancy Cevallos, 41, and her son, Raymond Cevallos,
26. Mr. Gutierrez suffered a gunshot wound to the back and died
at the scene. Ms. Cevallos was shot in the left hand and Mr. Cevallos
suffered multiple gunshot wounds to the back, chest and leg. The
Cevallos' were transported to Ben Taub General Hospital where
doctors said they are expected to recover from their injuries.
HPD Homicide Division Sergeant J.W. Belk and
Officer M.J. Miller reported:
The victims and suspect were in the restaurant
at 7715 Harrisburg when an argument began and escalated when the
suspect shoved another patron to the ground. The suspect was forced
out of the restaurant through a glass front door, which shattered.
The suspect had words with the Cevallos' and then pulled a .40-caliber
pistol and began shooting toward the restaurant. The Cevallos'
were shot as they ran back into the restaurant. The suspect followed
them back inside and continued shooting, firing about 13 more
times until his gun emptied. Gutierrez was shot while inside the
restaurant and Mr. Cevallos received several more gunshot wounds.
The suspect fled and was later arrested at his
residence.
