Incident at 5700 Cherbourg
April 3, 2006 -- A suspect who
refused to comply with commands to exit a vehicle and made a sudden
overt move in the vehicle at 5700 Cherbourg about 2:30 p.m. on
Sunday (April 2) was shot at by a Houston police officer.
The suspect, Shermaine Daniels (b/m, DOB 5-8-79),
was not hit. He was taken into custody without further incident
and charged with trespassing in Harris County Criminal Court #1.
HPD Homicide Division Sergeant M. K. Peters and
Officer A. J. Palos reported:
Officers dispatched to a weapons disturbance
call at 6702 Crestridge were told a vehicle involved in the disturbance
was driving near them. Officers were able to get the vehicle stopped
in the 5700 block of Cherbourg. Officers repeatedly gave verbal
commands to two males inside to exit the vehicle, but both males
refused to comply. After several attempts to get the two males
to exit the vehicle, the driver, Daniels, made a quick overt movement
to exit the vehicle. Officers had not been able to see if Daniels
was armed with a weapon. Fearing for the officers' safety, HPD
Officer K. P. Seitzinger, a six-year veteran with HPD, fired one
time at the suspect. The second male was released without charges.
As is customary when an officer discharges a
weapon in the city limits, the incident is being investigated
by the HPD Homicide and Internal Affairs Divisions and the Harris
County District Attorney's office.
