Incident at 3302 Creston

August 16, 2005 -- Charges are pending against a suspect who grabbed a Houston police officer's gun and fought with the officer at 3302 Creston about 12:15 a.m. today (Aug. 16).

The suspect is identified as Jamale Lewis (b/m, DOB 12-29-85). He faces charges including aggravated assault on a peace officer after he attacked and fought with Officer J.C. Sealy. The officer sustained minor injuries while the suspect was not injured.

HPD Homicide Division Sergeants C.W. Howard and M.W. McStravick reported:

Officers were called to 3302 Creston on reports of a kidnapping in progress. The officers were advised that a suspect armed with a gun had taken a victim to a room in the back of the residence. Officers approached the room and saw the suspect sexually assaulting the victim. Officers ordered the suspect out of the room and to get down on the floor. The suspect walked out of the room but refused officers' commands and ran past them and out the front door of the residence. Officers pursued the suspect on foot and one officer caught up with him and discharged a Taser at the suspect. The suspect fell to the ground, but got back up and again tried to escape after the Taser finished its cycle. The officer attempted to disable the suspect with the Taser several times, but it did not have an effect on the suspect.

The suspect then turned and grabbed the officer's neck and began choking him. As the officer attempted to free himself, both he and the suspect fell to the ground, with the suspect landing on top of the officer. The suspect then grabbed the officer's neck and again choked him. When the officer was unable to breathe, he attempted to shoot the suspect with his duty weapon. The weapon did not fire and the suspect grabbed the officer's gun and the two began to struggle with it. At one point, the suspect turned the barrel of the gun toward the officer. Fearing the suspect was going to shoot him, the officer was able to discharge his weapon into a vacant field before the suspect could aim the gun at him. When the gun was emptied, the suspect fled on foot. He was arrested a short time later at a nearby residence.

Officer Sealy, assigned to the Northeast Patrol Division, was sworn in as an HPD officer in December of 2002.
